This contract defines the terms and conditions under which the Vendor shall accept cards issued by the Issuer for payments, and governs the billing procedure.
A card is an electronic wallet in the form of a card with a unique number and a Benefit Plus logo, and can be used by the User to pay for specified services and goods provided by the Vendor.
Benefit Plus Card payments are made via a bank terminal, and are cleared and settled by its card acceptance service provider ("the Acquirer").
Benefit Plus cards for bank terminal payments are issued in the VISA payment standard. In the VISA scheme, every Benefit Plus card has a BIN range (fixed prefix) set to 416606.
The Issuer must ensure that all card transactions made via the Vendor's payment terminal are properly cleared through the VISA payment scheme. The billing process of card payments is governed by a separate contract or agreement concluded between the restaurant operator and the Acquirer. The commission for the Issuer of Benefit Plus cards, including all fees due to the Acquirer, is 4.9% of the volume of transactions made with these cards. This commission is included in the Acquirer's billing statements.
The Vendor undertakes to provide the Issuer with a list of its establishments that will be authorised to accept Benefit Plus card payments via the payment terminal and to subsequently inform the Issuer of changes to this list. The Vendor shall indicate a MID of each establishment, i.e. the identifier of the establishment in the payment terminal network. Alternatively, a TID may be provided instead of the MID.
The Issuer undertakes to promote the Vendor to its customers and the Benefit Plus card holders.
The Vendor undertakes to provide the User with its services and goods at the same prices and under the same conditions as for cash payment. The Vendor cannot require the User to pay the commission due to the Issuer. If the Vendor breaches this obligation, the Vendor must pay damages to the Issuer.
The Vendor further undertakes not to share any information regarding this contract or its parts with the User or any third party. If the Vendor breaches this obligation, the Vendor must pay damages to the Issuer. The only exception is the obligation of the Vendor under Act No. 340/2015 Sb. on special conditions for the effectiveness of some contracts, the disclosure of these contracts and the contracts register, if applicable.
The Vendor undertakes to use the personal data of Users solely to perform this Contract. If the Vendor breaches this obligation, the Vendor must pay damages to the Issuer.
The Vendor is responsible for the quality and scope of the services provided to the User, including the handling of any complaints or refunds. The Vendor undertakes not to fulfill the User's order or carry out a payment card transaction in monetary form, in whole or in part. The Vendor further undertakes to provide the User who is paying with a Benefit Plus card only with the services specified in the section Categories of services provided. For every breach of this obligation, the Issuer may charge the Vendor a contractual penalty amounting to the value of the order or card transaction.
The Vendor undertakes to visibly mark its establishment with the Benefit Plus logo in the form of a sticker provided by the Issuer or in another form at its discretion, and to provide information about the Benefit Plus payment option on its website.
The Contracting Parties undertake to inform the other Party in a timely manner, in advance, if possible, about any changes in the above-mentioned data, as well as about all facts that are important for the proper performance of this Contract.
This contract terminates the validity of the previous Acceptance Agreement for Orders and Benefit Plus cards, if it was previously concluded between the Issuer and the Vendor.
This contract may be amended and supplemented in writing or electronically with the consent of both parties.
Electronic versions of the contract in PDF formats are effective on the day they are sent by the Issuer to the Vendor's email address.
The contract is concluded for an indefinite period. The notice period is one month and begins on the first day of the month following the month in which the written notice was delivered to the other party.

The subject matter of the contract is to define the conditions under which the Vendor will accept orders and cards issued by the Issuer for payment and under which they will be billed.
An order is an electronic (email, SMS, mobile application) order on specified services or goods of the Vendor placed by the Issuer for the benefit of a third party - the User ('the User').
4. Payments with the Benefit Plus card are made either via a payment terminal or a virtual Benefit Plus account. Payments via the payment terminal are cleared and paid by the bank or the supplier of the Vendor's terminal together with other payment cards. Card payments made via the Benefit Plus Virtual Account and orders placed are cleared and paid for directly by the Issuer.
The Vendor accesses the virtual Benefit Plus account directly from its cash register system, if it is linked directly to the Benefit Plus authorization center, or via an internet browser after logging in with its username and password at www.benefit-plus.cz.
The Issuer shall reimburse the Vendor the value of each order that the Vendor marks as completed in its virtual Benefit Plus account. The Vendor guarantees to the Issuer that it has provided or will provide the User with goods or services in the confirmed value of the order that the Vendor marked as completed.
The Issuer must state the User's first and last name on the order. When placing a card payment, the Issuer must show the Vendor the User's first and last name in the Benefit Plus payment gateway. In the case of payments via payment terminals, the Issuer must ask the User to sign the card in the signature strip. The Vendor is responsible for providing services or goods to the required extent to the User by checking the User's name or signature against the submitted photo identification card.
The Issuer shall reimburse the Vendor for each card payment that has been duly authorized in the Vendor's virtual Benefit Plus account.
The Issuer must automatically make statements for the previous billing period within 3 working days of the end of the billing period. This electronic statement shall include an overview of the Issuer's liabilities towards the Vendor as the sum of completed orders and confirmed card transactions, and an invoice for commission as a claim of the Issuer against the Vendor. Within 3 working days of making the statements, the Issuer shall pay the amount due to the Vendor after the deduction of the commission charged. The Issuer also must make statements of redeemed vouchers immediately after they are marked as redeemed, if the Vendor makes such requests.
In case of failure to meet the above-stated deadlines, the Vendor may charge the Issuer a contractual penalty of 0.1% of the outstanding amount for each day of delay.
The Issuer must ensure that all card transactions made via the Vendor's payment terminal are properly cleared through the VISA payment scheme. The terms of billing and payment are negotiated between the Vendor and the acquiring bank in connection with their payment terminal and are not the subject matter of this contract. The bank commission always includes an interbank fee of 5%, which is payable to the card issuer.
If the interbank fee for transactions billed to the Vendor via the VISA payment scheme is higher than the agreed commission, the Issuer shall send the Vendor electronic documents for invoicing the Differential Retroactive Bonus. The Vendor may issue an invoice for the Differential Retroactive Bonus for the previous calendar month. The invoice shall be issued with a due date of 14 days and will be sent to the Issuer as an electronic invoice to partnerifaktury@benefit-plus.cz. The Issuer must pay the Differential Retroactive Bonus by bank transfer to the Vendor's account.
If the interbank fee for transactions billed to the Vendor via the VISA payment scheme is lower than the agreed commission, the Issuer shall issue an invoice for the Differential Retroactive Bonus for the previous calendar month. The invoice shall be issued with a due date of 14 days and will be sent to the Vendor in electronic form. The Vendor must pay the Differential Retroactive Bonus by bank transfer to the Issuer's account.
The Vendor further undertakes not to disclose any information regarding the content of this Agreement or its part to the User or any other third party. If this obligation is violated, the Vendor must compensate the Issuer for the damage caused. The only exception, in this case, are the obligations of the Vendor pursuant to Act No. 340/2015 Sb. on special conditions for the effectiveness of some contracts, publication of these contracts and the register of contracts, if applicable.
The Vendor is responsible for the quality and scope of services provided directly to the User, including the handling of any complaints. The Vendor undertakes not to fulfill the User's order or carry out a payment card transaction in monetary form, in whole or in part. The Vendor further undertakes to provide the User only with services that fall into the category of tax-advantaged (services in the field of public catering, education, travel, health, sport and culture) pursuant to Section 6 - Income Taxes Act No. 586/1992 Sb. and which are further defined in the section Categories of services provided in Part A of this Agreement. For each breach of this obligation, the Issuer may charge the Vendor a contractual penalty in the amount of the value of the order or card transaction.

The draft is accepted by creating an electronic version of the contract by Benefit Management and sending it to your email address. A presentation of your services in Benefit Plus will be created for you in accordance with the contract.
